Terms and Conditions

U.S. AGENTS ONLY
In
order to qualify for any Prizes and/or Booking Bonuses, each travel agent
must register
online at
www.occidentalhotels.info and agree to the terms and conditions
therein as well as the privacy policy.
Limited to one Prize per travel agent. In
order to qualify for the Grand Prize each travel agent must register a
minimum of 10 bookings. Other terms and conditions may apply. All bookings
referenced herein mean registered bookings made with a minimum three (3)
night stay that are non-refundable, non-transferable and non-assignable
and for which payment has been received and confirmed by Occidental. In
order to qualify for either of the 1st Place cash prizes, each
travel agent must register a minimum of 6 bookings for the corresponding
destination (Dominican Republic and Costa Rica). The 2nd, 3rd,
and 4th Place prizes shall be awarded to the travel agents with
the most overall bookings. Cash booking bonuses in the amount of $20 will be
paid for each new booking made at any one of our properties in the Dominican
Republic, Costa Rica, and Aruba. For a limited time only from June 13, 2005
– August 30, 2005, a booking bonus of $40 will be paid for travel during
June 13, 2005 – August 30, 2005 for each new booking at the Occidental Grand
Punta Cana, Allegro Punta Cana, Occidental Grand Papagayo and Allegro
Papagayo. Cash booking bonuses in the amount of $10 will be paid for each
new booking made at any one of our properties in Mexico. Booking
bonuses shall apply only for all new bookings, as of May 1, 2005 – May 31,
2006, for travel from May 1, 2005 – May 31, 2006. Royal Hideaway bookings
shall apply to all new bookings as of June 29, 2005 - May 31, 2006 for
travel from June 29, 2005 – May 31, 2006. Booking Bonus payments shall be
paid out on a quarterly basis, effective August 2005 and every quarter
thereafter until the completion of the promotional period, based on actual
paid consumed travel, by Performance Media Group, LLC Booking Bonus
payments are defined to be any payments made by Occidental Hotels & Resorts
to a travel agent pursuant to this Promotion. Agencies that prohibit Booking
Bonus payments from being made directly to their Agents shall not be
eligible for any Prizes, and must notify Occidental in writing, with payment
instructions in order to receive Booking Bonus payment(s). Group and travel
agent rate bookings are excluded from qualifying for Booking Bonuses.
Black-out dates and/or temporary closings apply to the following
destinations: Aruba – Allegro Aruba closed as of 04/30/05 and re-opening as
an Occidental Grand resort on 12/15/05; Costa Rica – from 12/20/05 -
4/17/06; Mexico – Cancun/Nuevo Vallarta from 7/1-8/20/05 and
12/20/05-4/17/06, and Cozumel/Riviera Maya from 6/15-8/30/05 and
12/20/05-4/30/06. Other restrictions may apply. Void where prohibited by
law. All Agent support and payment inquiries should be directed to

support@occidentalhotels.info. We reserve the right to cancel or alter
this promotion at any time without prior notice to you. All bookings and
reservations made on our web site are nonrefundable, and non-changeable and
non-transferable, notwithstanding any changes in travel plans, flight
delays, early check out of hotel, no show on car rentals, and missed
connections. We shall not be responsible for any loss incurred in connection
with this Promotion caused to any travel agent or guest in connection with
terrorist activities, social or labor unrest, mechanical or construction
failures or difficulties, diseases, local laws, climatic conditions,
abnormal conditions or developments, or any other actions, omissions, or
conditions outside our control. Travel agent is solely responsible for the
payment of any and all taxes incurred in connection with the receipt and
winning of any prize or cash bonus under this Promotion.
Occidental Hotels offers access to and
use of its web site, subject to the travel agent’s acceptance of the Terms
and Conditions stated therein, as well as our Privacy Policy. You may use
our web site for the purposes stated herein only and any other such use is
strictly prohibited. Travel agents may not modify, copy, distribute,
transmit, display, reproduce, publish, license, create derivative works
from, transfer, upload, post or sell any information, software, products, or
services obtained from our web site. Trademarks, logos, and service marks
displayed on our site are ours and our suppliers' registered and common law
marks and use, reproduction, or display of same is strictly prohibited. Use
of and access to our site does not grant the travel agent any license or
right to use any of the trademarks. It is the travel agent’s responsibility
to protect the confidentiality and security of any password used by the
travel agent to access our site or any password we provide to the travel
agent to access our site to participate in this Promotion. Occidental
assumes no liability for any access to information or transactions that are
executed with the password provided to the travel agent or selected by the
travel agent or used by the travel agent to access our web site. It is
recommended that the travel agent change your password periodically to
protect the integrity of the password. Occidental will disclose any
information regarding the use of its web site including personal information
pertaining to the travel agent or the travel agent clients without the
travel agent permission when required by law, or in good faith belief that
such action is necessary to investigate or protect against harmful
activities to Occidental guests, visitors, associates, or property
(including this site), or to others. We expressly disclaim any
representation or warranty that our site will be error-free, uninterrupted,
or secure and are not responsible for any interruption, errors, or breach of
security on our web site. Any warranty as to the accuracy, completeness, and
timeliness of content on our site is further disclaimed. We are not liable
for the actions or omissions on the part of our web site providers, which
result in any loss, damage, delay, or injury to the travel agent or the
travel agent clients. Payment will be made directly by Performance Media
Group, Inc. to the travel agent or travel agencies. Said bonuses will be
100% funded by Occidental and not paid to agent until those funds are paid
and received by Performance Media Group, LLC Travel agent/travel
agencies hereby agree that Performance Media Group, LLC is responsible for
payment of cash bonuses arising under this Promotion. It is agreed that all
disputes and matters whatsoever arising under or in connection with or
incident to this promotion shall be governed by the laws of the State of
Florida, in and for Miami Dade County, and any litigation arising from this
promotion shall be in the state courts in Florida, Miami Dade County to the
exclusion of the courts or any other state or country.
